SAND VOLLEYBALL GAB PARTICIPATION WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND MEDIA RELEASE

PLEASE READ CAREFULLY BEFORE SIGNING

By signing this document, you acknowledge that you are voluntarily participating in activities organized by Gooder at Beach and understand that you are waiving certain legal rights.

1. ASSUMPTION OF RISK

I understand that participation in sand volleyball and related activities involves inherent risks that cannot be eliminated regardless of the care taken by organizers, participants, or facility operators. These risks include, but are
not limited to:

 Slips, trips, and falls on uneven or shifting sand surfaces;
 Being struck by volleyballs or other equipment;
 Physical exertion, overexertion, dehydration, heat-related illness, or fatigue;
 Collisions with other participants, spectators, officials, or objects;
 Sprains, strains, fractures, dislocations, concussions, and other injuries;
 Exposure to weather conditions including heat, sun, wind, rain, lightning, and other environmental hazards;
 Risks arising from negligent acts or omissions of other participants.
I knowingly and voluntarily assume all risks, known and unknown, associated with participation in league activities and accept full responsibility for any injury, illness, damage, loss, or expense that may result.

2. RELEASE OF LIABILITY AND WAIVER OF CLAIMS

In consideration for being permitted to participate in Gooder at Beach activities, I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release, waive, discharge, and covenant not to sue:

 Gooder at Beach;
 Any league owner, staff, volunteers, officials, sponsors, agents, representatives, and affiliates;
 The venue owners, operators, and managers of the facilities used for league activities;
from any and all claims, liabilities, demands, actions, causes of action, damages, losses, costs, or expenses arising out of or related to any injury, illness, death, property damage, or other loss resulting from participation in league activities, whether caused by negligence or otherwise, to the fullest extent permitted by Colorado law.

3. PARTICIPANT HEALTH CERTIFICATION

I certify that:
 I am physically able and medically fit to participate in sand volleyball activities.
 I have no medical condition that would prevent safe participation.
 I understand that I am responsible for consulting a physician if I have concerns regarding my fitness to
participate.

 I will immediately stop participating and notify league officials if I experience symptoms that could endanger myself or others.

4. PARTICIPANT CONDUCT

I agree to:
 Follow all league rules, policies, and instructions from league officials.
 Conduct myself in a safe, respectful, and sportsmanlike manner.
 Refrain from behavior that may endanger other participants.
 Accept that league officials may remove me from participation without refund for unsafe, disruptive, abusive,
or unsportsmanlike conduct.

5. MEDICAL TREATMENT AUTHORIZATION

In the event of an emergency, I authorize Gooder at Beach and its representatives to obtain emergency medical treatment on my behalf if I am unable to provide consent. I understand that I am solely responsible for any medical expenses incurred.

6. MEDIA RELEASE

I grant Gooder at Beach, Andrew Zwahlen, and their authorized representatives the unrestricted right to photograph, videotape, record, and otherwise capture my image, likeness, voice, and participation during league activities.
I authorize the use of such photographs, videos, recordings, and related materials forpromotional, advertising,
marketing, social media, website, and other lawful business purposes without compensation or further approval.
I understand that I waive any right to inspect or approve the final use of such materials.

7. SEVERABILITY

If any provision of this Waiver and Release is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

8. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado. Any dispute arising from participation in league activities shall be brought exclusively in a court of competent jurisdiction located within the State of Colorado.

9. ACKNOWLEDGMENT

I acknowledge that I have carefully read this Waiver, Release of Liability, Assumption of Risk, and Media Release. I fully understand its contents and understand that I am giving up substantial legal rights by signing it. I sign this agreement freely and voluntarily without inducement.
